Under-insured Motorist and Uninsured Motorist Coverage in Michigan

We all have a right to life, liberty and the pursuit of happiness as our founding fathers attested to in the Declaration of Independence.  For example, if another driver causes a car accident because they were careless or negligent, any person that was injured may have a claim for money damages because of the injuries they suffered(non economic damages)

But what if you were struck by a driver that had little or no insurance?  This is when  you look to your own policy to see if you have purchased Under-insured MC or Uninsured MC.  If you are listening right now and you have not purchased these benefits do it today.  If you have purchased these benefits, I recommend that you get at least a half million in coverage so check your coverages.

Michigan law requires a minimum of only $20,000 to drive on the road.  This number goes back to the 1970’s and has not changed.  I have seen many cases involving serious injuries and death where the at fault driver had little or no insurance.  This is why you should purchase these benefits from your insurance company.

The way it works is if you were hit, for examples by an uninsured driver, and you suffered serious injuries, then you can make a claim for your uninsured motorist coverage benefits from you own insurance company.

Likewise if you were hit by a driver with very little insurance, such as a $20,000 policy, and you have serious injuries,  then you may make a claim against your insurance company for your under-insured motorist coverage benefits.  Please bear in mind that you must first obtain written permission from your auto insurance company to settle your claim with the at fault driver otherwise you will have waived this benefit.

Now please bear in mind that it is my opinion that insurance companies are in the business of making money and not paying claims.  So generally speaking, your insurance company is not going to just hand you over tons of money if you have these benefits.  They will want to litigate your claim and this why it is a good idea to have an experienced attorney on your side.
