Michigan Personal Injury Lawyer Gives Litigation Tip in a Personal Injury Lawsuit

I have a litigation tip today for those of you that are involved in a personal injury lawsuit in Michigan. That is to keep some sort of log or diary of how your injury affects your activities.
Now most attorneys will tell you that pretty much most cases settle, but however, there is a small percentage that end up going to trial and we as attorneys always have to be ready for a trial. So one thing that you might want to do to be ready for trial is to have a log or diary of how your injury affects you on a daily basis or monthly basis. It doesn’t have to be day to day. The reason being is it’ll give you a refresher for trial, in terms of how your injury has affected you. And more importantly, it will impact the jury’s view of you. It’ll add credibility to your testimony and weight to your testimony.
For example, if you’re on the stand and you’re testifying to the jury you can cite specific examples from your log or diary. For example, you might have an entry that September 14th my daughter was having a birthday party and I was bringing the cake to the table and because of my arm was weak I dropped the cake all over her and her friends and she had a bad birthday. Things like that. Stories like that really resonate with the jury. By keeping a log or diary, that enhances your memory in terms of some things that are affecting you on a day-to-day basis. And you only need to log in, you know, more significant types of things. You don’t have to log in or diary your, activities every day. So, my name is John Alexander.
